The Claimant sought TPD benefits following a shoulder injury. The Claimant refused to accept the light work duty available as the Claimant was taking narcotics and was concerned this would violate the Employer’s policy. However, the Employer’s policy allowed for this exception as the medication was from an authorized treating physician. Since the Claimant made no attempt to return to work light duty, the JCC denied the request for TPD benefits.
