McConnaughhay Coonrod Partner Ryan Davis was successful in defending against disability benefits following fraudulent behavior. Here’s a brief overview of the case:

 

Following a compensable accident in 1979, the Claimant relocated to Texas and underwent a lumbar fusion. The Carrier voluntarily accepted the Claimant as Permanently and Totally Disabled (PTD).  The Claimant wrote multiples letters and emails to the claims specialist, expressing her need for increased attendant care benefits because she was left nearly bedridden by her accident. Irregularities in the Claimant’s medical records led the Carrier to conduct surveillance. After numerous reports of the Claimant gardening, the Carrier denied further benefits. While the claim for attendant care benefits was withdrawn during the Final Hearing, the Judge of Compensation Claims found that the Claimant was unable to prove entitlement to continued PTD benefits.
