Here’s a brief overview of the case:
The Claimant alleged an injury to her knee and after treating at the PCP level, was referred to a knee specialist. The Employer/Carrier authorized the knee specialist prior to receiving a good faith request from the Claimant’s attorney and provided the appointment letter. Despite this, the Claimant’s attorney filed a Petition for Benefits the next day seeking authorization and provision of a knee specialist, compensability of the left knee condition, and PICA. The Employer/Carrier timely responded to the Petition and the issues were resolved. In this instance, the Claimant’s attorney failed to respond acknowledging the benefit was provided and due to this, a Motion for Summary Final Order showing the appointment letter was filed. The JCC granted the Motion since the benefit was provided.
