Our Civil Litigation Manager Partner, Hayley Lewis Folmar, received summary judgment for defendants on a Florida premise liability claim. The Florida Circuit Court ruled the two defendants, a shopping mall and retail store, owed no duty to an invitee who tripped over a concrete parking stopper.  The subject parking stopper, AKA wheel stop, was an open and obvious condition. The Court noted the parking stopper was concrete and placed upon asphalt, making it readily observable to the Plaintiff invitee, had she exercised a reasonable degree of care for her own safety.
