Plaintiff brought suit against his employer alleging discrimination on the basis of his race in violation of Title VII. Plaintiff, a deputy sheriff was given a work assignment which required him to patrol military housing between the hours of 11:00 p.m and 7:00 a.m. While on duty, plaintiff left his post, covered his uniform with civilian clothing and dropped his personal vehicle off with a friend.
