The trial court granted Securities' motion for summary judgment, holding that the record did not demonstrate that Wimberly had a disability under the Florida Civil Rights Act (FCRA) or the Americans with Disabilities Act (ADA). Wimberly appealed. Florida courts construe the FCRA in conformity with the ADA. Thus, a disability discrimination action is analyzed under the ADA.
