Nastase v. Florida Fish & Wildlife Conservation

The plaintiff filed a complaint alleging sex discrimination against the Commission. The Commission responded that the plaintiff had been an employee of the Florida Department of Law Enforcement, Department of Environmental Protection (DEP) and that the Commission was therefore not a properly named party. The Commission was formed in 1999 and some employees from the Department of Environmental Protection had been transferred to the Commission. The plaintiff argued that because some employees had been transferred, the Commission was liable under the successor liability theory.
